1.1 The promoter is Imbibe Living Pty Ltd (the “Promoter”), of 9B/11 Banksia Drive Byron Bay NSW 2481 Australia and ABN: 49 602 292 053.
2. Acceptance of these Terms
2.1 These Terms and Conditions govern the IMBIBE $1000 beauty and Wellness Edit (the “Competition”).
2.2 By entering the Competition, entrants agree to be bound by these Terms and Conditions.
3. Competition Period
3.1 The Competition opens at 8:00 AM AEST on 18 September 2026 and closes at 11:59 pm AEST on 1 December 2026 (the “Competition Period”).
3.2 Entries received outside the Competition Period will not be accepted.
4. Eligibility
4.1 Entry is open to Australian residents aged 18 years or over.
4.2 To be eligible, entrants must:

4.4 Directors, officers, employees and contractors of the Promoter, its related bodies corporate, and any agencies or companies associated with the Competition are not eligible to enter. Immediate family members of these individuals are also ineligible.
5. How to Enter
5.1 To enter, eligible entrants must fill out the entry form during the Competition Period.
5.2 Unless otherwise stated, only one entry per person is permitted.
5.3 No purchase is necessary to enter.
5.4 All entry instructions published by the Promoter form part of these Terms and Conditions.
5.5 Entries that are incomplete, illegible, corrupted, automated, fraudulent or otherwise not submitted in accordance with these Terms and Conditions may be deemed invalid.
5.6 The Promoter accepts no responsibility for entries that are late, lost, incorrectly submitted or not received due to technical problems or circumstances beyond the Promoter’s reasonable control.
6. Prize
6.1 There is one prize consisting of an IMBIBE gift pack valued at AU$1,075.
6.2 The prize includes:
6.3 All prize values are in Australian dollars and are correct at the time of publication.
6.4 The prize is not transferable, exchangeable or redeemable for cash.
6.5 If any prize item becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute it with an item of equal or greater value, subject to applicable law.
6.6 Any costs not expressly included in the prize are the responsibility of the winner.
7. Winner Selection
7.1 This is a game of chance. Skill plays no part in determining the winner.
7.2 The winner will be selected at random from all valid entries at 12noon AEST on 3 December 2026 at IMBIBE HQ.
7.3 The Promoter’s decision is final, and no correspondence will be entered into, except where required by law.
8. Winner Notification and Prize Claim
8.1 The winner will be notified by email using the address provided with their entry or newsletter subscription.
8.2 The Promoter is not responsible if it cannot contact the winner because the winner supplied incorrect or outdated contact information or because the notification is filtered into a spam or junk folder.
8.3 The winner must claim the prize within seven (7) days of being notified and provide any information reasonably required to verify their eligibility and arrange delivery.
8.4 If the winner cannot be contacted, is found to be ineligible or fails to claim the prize within the required period, the winner will forfeit the prize.
8.5 If required, an unclaimed-prize draw will be conducted at 12noon AEST on 11 December at IMBIBE HQ subject to any directions from a relevant regulatory authority. The replacement winner will be notified by email.
8.6 The winner’s name and state or territory of residence may be published on the IMBIBE website or social-media channels if required by law or a relevant regulatory authority.
9. Disqualification
9.1 The Promoter may disqualify any entrant who:

10.1 Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
10.2 To the maximum extent permitted by law, the Promoter and its associated agencies and companies will not be liable for any loss, expense, damage, personal injury or death suffered in connection with the Competition or the acceptance or use of the prize, except to the extent caused by the Promoter’s negligence or wilful misconduct.
10.3 If the Competition cannot proceed as planned because of circumstances beyond the Promoter’s reasonable control, the Promoter may modify, suspend, postpone or cancel the Competition, subject to applicable law and any directions from a relevant regulatory authority.
10.4 The Promoter accepts no responsibility for any tax implications arising from the prize. The winner should obtain independent financial advice if required.
11. Privacy and Marketing Communications
11.1 The Promoter will collect and use entrants’ personal information to administer the Competition, verify eligibility, select and contact the winner, deliver the prize and otherwise conduct the Competition.
11.2 The Promoter may disclose personal information to its related bodies corporate, contractors, service providers and regulatory authorities where reasonably necessary to conduct the Competition or comply with the law.
11.3 As newsletter subscription is a condition of entry, entrants agree to receive marketing communications from the Promoter. Entrants may unsubscribe at any time using the unsubscribe link included in an email. Unsubscribing before the winner is drawn will make the entrant ineligible to win.
11.4 Personal information will be handled in accordance with the Promoter’s Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11.5 Entrants may contact the Promoter to request access to or correction of their personal information.
12. Publicity
12.1 By accepting the prize, the winner agrees that the Promoter may publish their name and state or territory of residence for the purpose of announcing the Competition result, where permitted or required by law.
12.2 Any additional use of the winner’s image, testimonial or other promotional content will be subject to the winner’s consent, except where publication is required by law.
13. Withdrawal
13.1 An entrant may withdraw from the Competition by emailing hello@imbibeliving.com before the winner is drawn.
13.2 Once an entrant withdraws, their entry will be removed from the Competition and they will no longer be eligible to win.
14. Governing Law
14.1 These Terms and Conditions are governed by NSW Fair Trading.
14.2 Entrants submit to the jurisdiction of the courts of that state or territory and any courts entitled to hear appeals from them.
15. Currency
15.1 Unless otherwise stated, all dollar amounts referred to in these Terms and Conditions are in Australian dollars.
